A formal warning letter from the Department of Homeland Security's top lawyer to the American Immigration Lawyers Association marks an escalation in the Trump administration's immigration enforcement posture, extending pressure to the attorneys representing asylum seekers on top of existing measures targeting migrants directly.
Percival sent the letter to AILA on Wednesday and told Fox News Digital on Thursday that attorneys who commit fraud for clients will be fined.
The department warned it will vigorously pursue all available remedies against anyone filing claims with an improper motive. The throughput problem is what gives the warning its weight.
Percival cited a growing backlog in immigration courts as the capacity constraint the system cannot absorb more of, and framed the letter as a direct response to conduct he said exacerbates it.
