A lawsuit from New York state against prediction-market platform Kalshi, alleging an illegal gambling operation, puts the jurisdictional boundary between state gaming enforcement and federal prediction-market oversight in focus.

The case turns on whether prediction markets authorized at the federal level are subject to state gambling statutes, a question neither the state nor the Commodity Futures Trading Commission has resolved.

The charge and the setup New York has sued Kalshi on grounds that the platform is operating an illegal gambling operation. Kalshi is federally regulated by the CFTC.

The state's legal action places that federal authorization in direct conflict with New York's own gaming enforcement authority.
