Senate pressure on Anthony Fauci sharpened after the former White House COVID-19 advisor invoked his Fifth Amendment right more than 100 times at a Senate Homeland Security and Governmental Affairs Committee hearing Wednesday, declining every question put to him. Sen. Ted Cruz, R-Texas, responded by calling for contempt charges, a perjury prosecution, and a prison sentence, labeling Fauci "the most damaging bureaucrat in the history of America." Committee Chairman Rand Paul separately announced he will seek formal contempt charges after the hearing.

Senate pressure on Anthony Fauci sharpened after the former White House COVID-19 advisor invoked his Fifth Amendment right more than 100 times at a Senate Homeland Security and Governmental Affairs Committee hearing Wednesday, declining every question put to him. Sen. Ted Cruz, R-Texas, responded by calling for contempt charges, a perjury prosecution, and a prison sentence, labeling Fauci "the most damaging bureaucrat in the history of America." Committee Chairman Rand Paul separately announced he will seek formal contempt charges after the hearing.

What Cruz is alleging

Cruz grounded his demand in Fauci's released private diaries. He told Fox News Digital that the diaries show Fauci wrote early in the pandemic that the COVID-19 virus clearly did not come from the wet market in Wuhan, then made the opposite claim on national television. The diaries, Cruz said, also show Fauci personally convinced officials in New York and California to close their state school systems, while Fauci later testified to the House Oversight Committee and said publicly that he "did not close the schools."

"In his diary, he brags about convincing Democrats in New York and California to shut schools down, and yet he goes on TV and says, 'Oh, I wasn't for shutdowns,'" Cruz told Fox News Digital.

School closures and the learning-loss argument

Cruz called the school closures potentially "the single most destructive public policy step we've seen in decades." He argued the resulting learning loss will follow affected children for the rest of their lives. Cruz and Fauci have a longstanding public dispute, as does Rand Paul, over Fauci's handling of the COVID-19 outbreak and his public statements on the virus's origins.

The released diaries show that scientists considered the possibility of a deliberately inserted laboratory origin as worthy of expert review. Fauci's later public statements, as Cruz described them, went the other direction.

What to watch

Rand Paul's formal contempt referral is the next confirmable step. Cruz called for Fauci to be held in contempt, prosecuted for perjury, and sent to jail. No date for either action has been established on the record.
