How the vote collapsed
Seven Democratic senators who helped draft the bill, including Kirsten Gillibrand, Mark Warner, Cory Booker, Raphael Warnock, Ruben Gallego, Angela Alsobrooks, and Catherine Cortez Masto, voted against it anyway. The text they rejected had incorporated 126 changes they had requested. Senator Elissa Slotkin explained her no vote by calling the ethics provisions "simply too thin" and cited concerns over money-laundering safeguards and CFTC staffing levels.
Four Republicans broke ranks too. Susan Collins, Josh Hawley, and Jerry Moran opposed the stablecoin yield provision after community banks raised concerns. Tillis voted no for procedural reasons before filing his motion to reconsider. Talks in Tillis's office had broken down after a staffer for Senator Tim Scott indicated negotiations were over. After the roll call, an industry leader texted reporter Eleanor Terrett: "It died."
The ethics package at the center of the dispute covered the president's spouse but excluded his children, whose venture, World Liberty Financial, trades in cryptocurrency. The package was also set to expire in January 2029. Senator Chris Coons did not vote.

XRP's commodity status rests on a joint SEC-CFTC interpretation from March 17, 2026, plus five spot ETFs, Ripple Prime as a prime-brokerage offering, and RLUSD, Ripple's stablecoin carrying $2.4 billion in circulation. That position is tentatively secure but reversible by a different set of commissioners.
Bitcoin was not depending on any statute. Congress has never passed one for any cryptocurrency, and $BTC's setup comes from regulatory consensus, spot ETFs, and corporate treasury buying. Kalshi priced passage before January 1, 2027, at 20%. Polymarket, which had the bill at 82% likelihood in February, moved to near 7% after the roll call. The House has already canceled its late-September voting weeks. CME FedWatch put a 25-basis-point rate hike at the September 16 meeting at between 88% and 94% as of September 15, with the fed funds upper bound at 3.75%, adding macro pressure to XRP's agency-document footing.
